Welcome to Dormylabs. These Terms of Service ("Terms") govern your access to and use of the Dormylabs website, products, and services. By accessing our website or purchasing from us, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use our website or services.
Throughout these Terms, "Dormylabs," "we," "our," and "us" refer to Dormylabs and its affiliated business operations, specifically managed under the corporate entity L.C.M. E-commerce. "You" refers to any user, customer, or visitor of our website.
1. ELIGIBILITY
By using this website, you represent and warrant that:
  • You are at least 18 years of age or have permission from a parent or legal guardian.
  • You have the legal capacity to enter into a binding agreement.
  • All information you provide is accurate, complete, and current.
  • You will use this website only for lawful purposes.
Dormylabs reserves the right to refuse service, cancel orders, or terminate accounts at our sole discretion if we believe these Terms have been violated.
2. ONLINE STORE TERMS
By agreeing to these Terms, you may not use our products for any unlawful or unauthorized purpose. You agree not to:
  • Violate any applicable federal, state, or local laws.
  • Attempt to interfere with the security or operation of our website.
  • Upload viruses, malware, or malicious code.
  • Use our website for fraudulent activity.
  • Copy, reproduce, or exploit any part of the website without our written permission.
Any violation of these Terms may result in immediate termination of your access.
3. PRODUCTS AND FULFILLMENT MODEL
Dormylabs strives to display product descriptions, specifications, images, and pricing as accurately as possible. However:
  • Product colors may vary depending on your device or screen settings.
  • Images are for illustrative purposes and may differ slightly from the final product.
  • Product specifications may change without prior notice as part of ongoing product improvements.
  • We reserve the right to discontinue any product at any time.
Fulfillment Disclosure: You acknowledge and agree that Dormylabs utilizes a direct-to-consumer fulfillment network. To ensure efficient delivery and minimize logistics overhead, products are dispatched directly from our international fulfillment centers and partner supplier facilities located overseas (including, but not limited to, East Asia) to the shipping address provided by you. Dormylabs operates as a retail distributor and does not physically store or inspect individual inventory items at our corporate registration office prior to shipment.
4. PRODUCT USE & SAFETY
Dormylabs products are intended to be used only in accordance with the instructions and user manuals provided with the product. Customers agree to:
  • Read all instructions, warnings, and guidelines before first use.
  • Use the product only for its intended and legal purpose.
  • Keep the product away from children unless supervised by an adult.
  • Stop using the product immediately if it becomes damaged, overheats, or malfunctions.
Dormylabs shall not be responsible for damages resulting from misuse, unauthorized modifications, improper charging, battery neglect, accidental damage, or failure to follow the provided safety instructions.
5. PRODUCT COMPLIANCE
Dormylabs products are designed and manufactured by third-party suppliers to comply with applicable safety and regulatory standards required for the markets in which they are sold.
  • Where required by applicable law, third-party manufacturers represent that products have been tested or certified for relevant safety, transportation, battery (including Lithium-ion safety guidelines), electromagnetic compatibility, or wireless communication requirements (such as FCC regulations where applicable).
  • Dormylabs relies on compliance documentation and representations provided by its manufacturing and fulfillment partners where applicable. Nothing in these Terms shall be interpreted as limiting any mandatory consumer rights provided under applicable local consumer protection laws.
6. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE, SERVICES, AND ALL PRODUCTS DELIVERED TO YOU BY DORMYLABS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
DORMYLABS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT PRODUCT DESCRIPTIONS, IMAGES, OR SPECIFICATIONS ARE ENTIRELY ERROR-FREE, ACCURATE, OR THAT THE PRODUCTS WILL MEET YOUR SPECIFIC EXPECTATIONS OR REQUIREMENTS.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DORMYLABS, ITS DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR PROPERTY DAMAGE (INCLUDING PROPERTY DAMAGE CAUSED BY ELECTRICAL FAULTS, SHORT CIRCUITS, OVERHEATING, OR FIRE), ARISING OUT OF OR IN CONNECTION WITH YOUR PURCHASE, USE, OR INABILITY TO USE ANY DORMYLABS PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DORMYLABS’ TOTAL AGGREGATE LIABILITY FOR ANY CLAIM, LAWSUIT, OR DISPUTE ARISING OUT OF A PRODUCT OR ITS USE SHALL NOT EXCEED THE ACTUAL NET AMOUNT PAID BY YOU TO DORMYLABS FOR THE SPECIFIC PRODUCT GIVING RISE TO THE LIABILITY.
8. PRICING
All prices displayed on our website are shown in the currency selected by the customer. Prices are subject to change without prior notice. Dormylabs reserves the right to:
  • Correct pricing or typographical errors.
  • Cancel orders resulting from incorrect pricing.
  • Modify or end promotions at any time.
Applicable sales taxes, customs duties, import fees, and shipping charges will be displayed during checkout where required.
9. ORDERS
After placing an order, you will receive an order confirmation email. This confirmation does not constitute final acceptance of your order. Dormylabs reserves the right to:
  • Refuse or cancel any order for any reason.
  • Limit quantities purchased per person, household, or order.
  • Cancel suspected fraudulent, high-risk, or unauthorized transactions.
  • Request additional verification before processing an order.
If your order is cancelled after payment has been received, a full refund will be issued to your original payment method.
10. PAYMENTS
Dormylabs accepts various secure payment methods displayed during checkout. Payment must be successfully authorized before an order can be processed. By submitting payment information, you represent that:
  • You are authorized to use the selected payment method.
  • The billing information provided is accurate and complete.
  • You authorize Dormylabs to charge the full purchase amount, including applicable taxes, customs duties, and shipping charges.
Dormylabs does not store full payment card information. Payment processing is handled securely by trusted third-party payment providers.
11. SHIPPING, IMPORTS, AND CUSTOMS DELAYS
Because our products ship directly from international suppliers, shipping and customs handling are subject to international transit regulations.
  • Estimated delivery times are provided for convenience only and are not guaranteed. Delivery times may vary due to customs inspection processing, carrier delays, weather conditions, holidays, or other circumstances beyond our control.
  • Risk of Loss: Risk of loss and title for purchased products pass to the customer upon delivery to the shipping address provided at checkout. Dormylabs is not responsible for packages stolen after verified delivery by the carrier (e.g., package theft or "porch piracy").
  • Import and Customs Fees: Where applicable under the laws of the destination country, the customer may be considered the importer of record and may be responsible for any import duties, taxes, customs clearance fees, or similar charges levied once the package reaches your country.
  • Customers are responsible for providing accurate shipping information. Dormylabs is not responsible for delays, losses, or additional costs resulting from incorrect or incomplete shipping information.
12. 60-MORNING RISK-FREE TRIAL
Eligible products purchased directly from Dormylabs' official website (www.dormylabs.com) may qualify for our 60-Morning Risk-Free Trial, subject to the terms of our separate Refund Policy.
  • Customers who are not completely satisfied may request a return within the applicable trial period, provided the product is returned in accordance with the conditions outlined in our Refund Policy.
  • The 60-Morning Risk-Free Trial applies only to purchases made directly through our official website and does not apply to purchases made through third-party platforms or marketplaces.
  • Dormylabs reserves the right to deny refund requests that do not meet the requirements outlined in our Refund Policy.
13. DORMY CARE+
Dormy Care+ is an optional protection plan available for eligible purchases at the time of checkout. Dormy Care+ is entirely separate from our 60-Morning Risk-Free Trial and is intended to provide additional post-purchase protection after the standard trial period has concluded.
  • Coverage: Subject to the terms of the separate Dormy Care+ Protection Plan agreement, Dormy Care+ may provide a product replacement or other applicable remedy if the eligible product experiences a covered mechanical, electrical, or manufacturing malfunction within one (1) year from the confirmed date of delivery.
  • Exclusions: Dormy Care+ is strictly limited to manufacturing defects and does not cover any issues arising from external factors. TO THE FULLEST EXTENT PERMITTED BY LAW, DORMY CARE+ DOES NOT COVER, AND NO REMEDY SHALL BE PROVIDED FOR:
    1. Loss or theft of the product;
    2. Accidental damage, drops, or impacts;
    3. Cosmetic damage (including scratches, dents, or discoloration) that does not directly affect the core functionality of the product;
    4. Damage caused by misuse, abuse, neglect, improper or unapproved charging methods, battery neglect, unauthorized modifications, or failure to follow the provided safety instructions and user manuals;
    5. Normal wear and tear over time;
    6. Moisture, liquid, or water damage;
    7. Any issue or defect that is already eligible for return or replacement under our 60-Morning Risk-Free Trial; or
    8. Any claim that falls outside the explicit coverage parameters described in the standalone Dormy Care+ Protection Plan document.
  • Governing Terms: Coverage, specific eligibility requirements, exclusions, claim procedures, and available remedies are governed exclusively by the separate, standalone Dormy Care+ Protection Plan agreement.
  • Modifications: Dormy reserves the right to modify, suspend, or discontinue the Dormy Care+ program for future purchases at any time without prior notice. Any such modifications will not affect protection plans that were already successfully purchased and paid for prior to the date of modification.
14. PROMOTIONS & DISCOUNTS
From time to time, Dormylabs may offer promotional discounts, coupon codes, limited-time offers, or special pricing. Unless otherwise stated:
  • Promotions cannot be combined.
  • Discount codes have no cash value.
  • Promotions may expire without notice and cannot be applied retroactively after an order has been placed.
Dormylabs reserves the right to cancel or modify promotions at its sole discretion.
15. USER ACCOUNTS
Certain features of our website may require the creation of a user account. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account. Dormylabs reserves the right to suspend or terminate accounts suspected of fraudulent, abusive, or unauthorized activity.
16. REVIEWS & USER CONTENT
If you submit reviews, testimonials, comments, photographs, videos, or other content to Dormylabs, you grant Dormylabs a worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, modify, publish, distribute, and display such content for marketing, advertising, promotional, or business purposes.
You represent that:
  • You own or have legal permission to submit the content.
  • Your content does not infringe the intellectual property or privacy rights of any third party.
  • Your submission of content is entirely voluntary, and Dormylabs is under no obligation to maintain confidentiality or provide financial compensation for any user content.
17. GOVERNING LAW AND DISPUTE RESOLUTION
THESE TERMS AND ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF YOUR PURCHASE OR USE OF DORMYLABS PRODUCTS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE NETHERLANDS, WITHOUT REGARD TO CONFLICT OF LAW PRINCIPLES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR OUR PRODUCTS SHALL BE RESOLVED THROUGH BINDING, INDIVIDUAL ARBITRATION RATHER THAN IN COURT. YOU EXPLICITLY AGREE TO WAIVE YOUR RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, OR IF THE ARBITRATION PROVISIONS HEREIN ARE FOUND TO BE UNENFORCEABLE, BOTH PARTIES AGREE THAT SUCH DISPUTE SHALL BE SUBMITTED EXCLUSIVELY TO THE COMPETENT COURTS OF THE NETHERLANDS.
